Council, not public vote, must decide fireworks discharge dates

Sioux City cannot legally hold a public vote to determine whether fireworks discharge will be banned or limited further next year, according to an opinion from the city attorney.

“Neither the Code for the State of Iowa nor the Sioux City Municipal Code provide initiative or referendum power directly to the citizens on this matter,” the city said in a news release Wednesday.

The statement came two days after the City Council had directed city attorney Nicole DuBois during Monday’s meeting to research whether the city could allow a public vote in November on fireworks discharge.

The city’s first holiday with legalized fireworks discharge sparked debate between those who believe the city should have looser or more strict guidelines.
