Bill Cosby Sued For Defamation

There are now over 30 women accusing Bill Cosby.  Mr. Cosby cannot be charged criminally because the crimes occurred years ago and the state only has a certain number of years to prosecute for most crimes. A few of the victims have filed defamation cases against Bill Cosby for calling them liars when they spoke out.  A deposition of Bill Cosby released this week told a different story.

Although it varies by jurisdiction, to be successful in the defamation case, the victims must prove:

  1. Mr. Cosby made a false and defamatory statement concerning the Plaintiff.
  2. Mr. Cosby made an unprivileged publication to a third party.
  3. The publisher acted at least negligently in publishing the communication.
  4. Some jurisdictions require Plaintiff to prove special damages.

This is a difficult case to predict.  It has a high probability of being appealed on either side.
