There are now over 30 women accusing Bill Cosby. Mr. Cosby cannot be charged criminally because the crimes occurred years ago and the state only has a certain number of years to prosecute for most crimes. A few of the victims have filed defamation cases against Bill Cosby for calling them liars when they spoke out. A deposition of Bill Cosby released this week told a different story.
Although it varies by jurisdiction, to be successful in the defamation case, the victims must prove:
- Mr. Cosby made a false and defamatory statement concerning the Plaintiff.
- Mr. Cosby made an unprivileged publication to a third party.
- The publisher acted at least negligently in publishing the communication.
- Some jurisdictions require Plaintiff to prove special damages.
This is a difficult case to predict. It has a high probability of being appealed on either side.
